In Consideration of A Piece Of My HeART Project Canvas Art, each artist is reffered to as “I/me/my/your/the artist/the donor”
A Piece Of My HeART Project has agreed to give me one precut canvas of the approximate length of 12 inches for the sole purpose of donating canvas art to A Piece Of My HeART Project. Additional canvases will be available upon my request, at the discretion of the project. All canvas (used or unused) will be returned to A Piece Of My HeART Project on or before the six month deadline (which shall be determined by original postmark of each individual canvas sent to the artist).
A Piece Of My HeART Project will use only the artist’s name and location submitted for the public registry to promote, display and represent the donor of the canvas art.
A Piece Of My HeART Project will not consider and is under no obligation to consider any canvas art that is presented to them without regards to the guidelines and goals of the project and/or without the proper documentation.
A Piece Of My HeART Project agrees to not give any outside source my private registry information except in regards to verify some legal aspect of the project (ie. to verify records) unless I give them permission to do so through the submission of this information via the public registry. A Piece Of My HeART Project will never knowingly sell or give out said private information for financial gain.
I agree that A Piece Of My HeART Project shall not be liable to me or my personal representatives for any loss, damage or injury caused to myself or my property during or in connection with the creation, display, storage or representation of the canvas art I am donating.
I will only submit canvas art that is originally created by me (the artist) and I will indemnify A Piece Of My HeART Project against any claims by third parties in connection with the canvas art.
I agree to accept A Piece Of My HeART Project’s decision whether or not to include my donated canvas art donation in any publication or production (private or public) and realize that A Piece Of My HeART Project is under no obligation to include this canvas art if they decide it does not represent their project guidelines and/or goals.
I grant A Piece Of My HeART Project ownership rights to the canvas art donated and any materials associated with the canvas art for the use of promoting the goals of A Piece Of My HeART Project. In connection with the business of A Piece Of My HeART Project, this includes the right to alter the work for publication or production purposes in order to promote the project both privately and publicly.
I acknowledge that I have read and understood the “Canvas Agreement” and “Artist’s Guidelines” and confirm that the canvas art I have created is original and that no parts of the canvas art have been copied from materials with rights owned by third parties.
I agree that I do not and will not require A Piece Of My HeART Project to identify me as the creator of any of the canvas art in any publication or production. However, when possible, A Piece Of My HeART Project agrees to give me recognition for my canvas art donation, at their discretion.
I acknowledge that so far as I am aware the information and facts I am providing are true;
I agree that the personal information that I am providing may be held and used by A Piece Of My HeArt Project and its agents or affiliates for legal purposes.
A Piece Of My HeART Project Canvas Agreement shall be governed and construed in accordance with the laws of the United States Of America and the parties hereby submit to the non-exclusive jurisdiction of the Federal Courts.
